Governing Personal Data in the Digital Economy: A Comparative Study of the EU and China and Implications for Future Regulation

Die Forschung überprüft und analysiert kritisch die Regulierungsinstrumente und Governance-Modelle, die entweder in der EU oder in China erprobt wurden, um ein Gleichgewicht zwischen unternehmerischer Innovation und dem Schutz der Verbraucherrechte im Zusammenhang mit personenbezogenen Daten herzustellen. Es wird auch analysiert, wie sich die Allgemeine Datenschutzverordnung der EU (GDPR) auf die Datenschutzpraktiken in China auswirkt, dem größten digitalen Markt der Welt ohne ein einheitliches Datenschutzrecht.

Indem analysiert wird, wie verschiedene Rechtssysteme versuchen, die Datennutzung dieser Unternehmen bei der Anwendung neuer/aufkommender Technologien einschließlich KI zu regulieren, identifiziert die Forschung sowohl vielversprechende Ansätze als auch gescheiterte Versuche. Die Forschung schlägt auch Ansätze zur Bewältigung wichtiger regulatorischer Herausforderungen vor, vor denen die EU steht, da bisher kein internationaler Rahmen für die Interoperabilität zwischen den EU-Mitgliedstaaten wirksam umgesetzt wurde. Anschließend wird ein zukunftsweisendes polyzentrisches Governance-Modell ("TECM") entwickelt, das das Vertrauen zwischen den Betroffenen, den Regulierungsbehörden und den Regulierten stärkt und einen wirksameren Schutz der Rechte des Einzelnen auf seine eigenen Daten bietet.
