Forschungsprojekt am Centre

Critique of the Liberal State, Private Property and Legal Reform: Late 19th Century Experiences and Their Legacies

Das Projekt analysiert ausgehend von der Habsburgermonarchie die Kritik an der liberalen Gesetzgebung des Grundeigentums am Ende des 19. Jahrhunderts in einer vergleichenden und transnationalen Perspektive. Es werden die beteiligten Akteure sowie die Form und historische Dynamik des Feldes identifiziert, in dem Kritik geäußert und politische Lösungen artikuliert wurden. Das Projekt fragt dabei nach transnationalen Lernprozessen und Kooperationen im Umgang mit der rechtlichen und ökonomischen Fragilität von Eigentumsverhältnissen in ländlichen Gesellschaften im Prozess ihrer kapitalistischen Transformation. Während meines Aufenthaltes am Kolleg konzentriere ich mich auf die Arbeiten des Rechtssoziologen und späteren Rektors der Universität Czernowitz, Eugen Ehrlich (1862–1922) und des britischen Juristen Henry Sumner Maine (1822–1888) und frage nach intellektuellen Interferenzen und kulturübergreifenden Lernprozessen im globalen Kontext..
