Fellowship

Dr Janet Hui Xue joined the research group 'Global Cooperation and Polycentric Governance' in October 2020 and will be a Senior Research Fellow at the Centre until September 2021.

 

Research Project at the Centre

Governing Personal Data in the Digital Economy: A Comparative Study of the EU and China and Implications for Future Regulation

The research reviews and critically analyses the regulatory tools and governance models that have been tried in either the EU or China in attempts to strike a balance between business innovation and the protection of consumer rights in the context of personal data. It also analyses how the EU General Data Protection Regulation (the GDPR) affects the data protection practices in China, the largest digital market in the world without a unified data protection law.

By analysing how different legal systems attempt to regulate the data use of these companies in applications of new/emerging technologies including AI, the research identifies both promising approaches and failing attempts. The research also suggests approaches to tackle important regulatory challenges the EU is facing, given that no international framework for interoperability amongst EU member states has been effectively implemented yet. It then develops a forward-looking polycentric governance model ('TECM') that enhances trust between data subjects, regulators, and the regulated, and which provides more effective protection for individuals’ rights to their own data.
